Files Price-fixing Suit On Packaged Ice.
On March 25, 2008, Malkinson & Halpern, P.C.
filed a price-fixing class action in Dallas, TX
on behalf of its client, a 7-11 Store franchisee,
and other direct purchasers of packaged block, crushed
and cubed ice.
The suit alleges that the country’s primary manufacturers
of packaged ice, Artic Glacier, Reddy Ice, and
Home City Ice Company, conspired to artificially
elevate the price of packaged ice sold from at
least January 1, 2002, to the present.
Defendant, Arctic Glacier disclosed recently
that its corporate headquarters were searched
by the Department of Justice in connection with
the government's related criminal investigation.
Under federal statutes, direct purchasers from
members of price-fixing cartels are entitled to
a variety of relief, including triple damages
and attorneys' fees. It is generally irrelevant
that a direct purchaser may have passed the non-competitive
pricing on to their customers, as the law will
consider the purchaser to have been damaged by
its own overpayment.
