MHPC Files Racial Discrimination Class Action Against Chicago Dept. of Transportation.

On February 12, 2010, Malkinson & Halpern, P.C. filed a federal class action lawsuit against the City of Chicago’s Department of Transportation, alleging a climate and culture of racial discrimination and retaliation has injured minority workers.  The lawsuit alleges that workers have been subjected to racist name-calling and mocking by superiors, retaliation for complaining about the hostile conditions, and that the Department’s policies have resulted in segregating African American workers both in the office and into jobs involving south side wards, while non-African American workers are given assignments in more affluent north side wards, offering a better work environment and opportunities for advancement.

John Malkinson states that, “As we understand things, the work environment endured by our client and her coworkers is something out of pre-civil rights Mississippi.  It’s not supposed to be that way in 21st century Chicago. For this kind of conduct to happen in City government is shocking.” Before the lawsuit was filed, the federal Equal Employment Opportunity Commission conducted its own investigation concluding, in part, that “the evidence obtained in the investigation establishes reasonable cause to believe [the Chicago Department of Transportation] discriminated against a class of employees” because of their race, in violation of federal law.  [See case number, 10 C 00989, Federal District Court, Northern District of Illinios]
